What should you do if you receive a
Notice of Probation and
Suspension, Revocation and/or any
Notices from the DMV regarding your Driving
License?
Call our Offices today at (714) 828-2178
and/or (800) 370-5114 for a Free Consultation.
The DMV has established Point Limits, Time
Periods and Procedures to determine if a Driver
is a “Negligent Operator.” We have conducted
100s of DMV Negligent Operator Hearings.
We
will protect your rights.
If you receive too many Traffic Citation
Convictions, the DMV can suspend and/or revoke
your Commercial License. Even if a Judge permits
you to attend Traffic School, if you had a
Commercial License at the time of the Traffic
Violation, the Citation will still appear on
your Driving Record notwithstanding the type of
vehicle you were operating when cited.
The DMV, DOT (Department of Transportation) and
the General Public has a vested interest in
maintaining safety along and upon the Highways
within the United States. This concern and
interest is not without foundation.
The Federal Motor Carrier Safety Administration
(FMCSA) and the National Highway Safety
Administration (NHTSA) of the U.S. Department of
Transportation (DOT) conducted a study of
Accidents involving Large Trucks (some States do
not report all FMCSA eligible crashes). Large
Trucks refer to a Vehicle designed, used or
maintained primarily for carrying property, with
a gross vehicle weight rating or gross
combination weight rating of more than 10,000
lbs.
The following is a National Summary of Large
Trucks involved in Fatal and Non-Fatal
Accidents:
2002
116,651
2003
125,456
2004
139,302
2005
145,447
2006

California and other States have effected Point
Systems to help maintain Highway Safety by
suspending and/or revoking the Driving Privilege
of Negligent Drivers.
Most moving Citation Convictions received in a
Class “A” Commercial Vehicle are assigned 1.5
points on your Driving Record. Some are assigned
2 points. Other Convictions mandate an automatic
Suspension and/or Revocation.
Most Log Book Violations are assigned 1.5
points. Other Convictions mandate more serious
consequences. Many Drivers, erroneously, believe
they can simultaneously maintain 2 Log Books
and/or falsify their Log Book, both resulting in
severe penalties.
The majority of Equipment Violations, commonly
referred to as “Fix It Tickets,” are assigned
1.5 points. Numerous California Vehicle Codes
apply directly to particular Equipment
Violations. Many Law Enforcement Officers in
California denote some Equipment Citations as
Violations of California Vehicle Code § 34506.3
which are assigned 1.5 points on your Driving
Record.

Commercial Class “A” Drivers License.
